FRE 702 Amendments and Experts in Plaintiffs’ Employment Cases

On December 1, 2023, new amendments to Federal Rule of Evidence (FRE) 702 went into effect, which governs the admissibility of expert witness testimony. This panel will discuss the potential impact of the amendments on plaintiff-side employment cases, including experts frequently used, including (1) healthcare practitioners who opine on whether workplace stressors caused or exacerbated the employee’s mental health issues; and (2) vocational experts who opine on whether the employee reasonably mitigated their economic damages.
