Severance Agreements: How the NLRB Has Changed the Rules


On February 21, 2023, the National Labor Relations Board issued a decision in McLaren Macomb.  In its decision, the Board issued the groundbreaking holding that both non-disparagement and confidentiality clauses in severance agreements are unlawful, reasoning that these provisions have a reasonable tendency to interfere with, restrain, or coerce the exercise of employee rights under Section 7 of the National Labor Relations Act. In this webinar, panelists from both the employee-side bar and the management-side bar will discuss common questions that have arisen from employment attorneys regarding the practical application of the McLaren McComb decision.
