Policy Debates: How a Defendant’s Insurance Coverage Can Affect Employment Mediations

This event is co-hosted by the College of Labor and Employment Lawyers Everyone knows it, but it’s rarely discussed: The terms of a defendant’s EPLI or D&O policy can drive the timing and outcome of settlement talks in a workplace legal dispute. Indeed, the employer’s insurance company and its adjusters often become key players in a mediation, either obstructing or facilitating an agreement. Join us on March 8 as we demystify the role of insurance policies with two federal judges and two employment lawyers — one from each side of the aisle. We’ll review the most common terms in these policies, and how they can limit a defendant’s practical options during negotiation. How much can plaintiffs know about coverage limits, and how should that affect their strategy? How do judges regulate the influence of insurance adjusters during a court-ordered mediation? Each panelist will offer practice tips, war stories, and advice on recognizing whether a trial is avoidable or inevitable. This event does not offer CLE credit.
