Everyone knows it, but it’s rarely discussed: The terms of a de fendant’s EPLI or D&O policy can drive the timing and outcome of settle ment talks in a workplace legal dispute. Indeed, the employer’s insurance c ompany and its adjusters often become key players in a mediation, either ob structing or facilitating an agreement. Join us on March 8 as we demystify the role of insurance policies with two federal judges and two employment l awyers — one from each side of the aisle. We’ll review the most common term s in these policies, and how they can limit a defendant’s practical options during negotiation. How much can plaintiffs know about coverage limits, an d how should that affect their strategy? How do judges regulate the influen ce of insurance adjusters during a court-ordered mediation? Each panelist w ill offer practice tips, war stories, and advice on recognizing whether a t rial is avoidable or inevitable.
