Out-of-Court Statements in Employment Cases: What’s Admissible? A free webinar co-sponsored by the MWELA Bench Bar Committee and the Virginia Employment Lawyers Association, Fairfax County Bar- Employment Law Section, and the Virginia Trial Lawyers Association. By their nature, employment cases often pivot on out-of-court statements. “You’re getting too old for this job” is a classic example. But can such purported statements enter a case as evidence, or are they inadmissible hearsay? Reports of slurs by co-workers, internal investigation reports, troubling text messages, notes about what happened during a video conference: All may be challenged as hearsay, or statements made outside of court and offered to prove the truth of the matter asserted. How do plaintiffs’ attorneys get such statements into evidence — and how can defense counsel prevent it? What is a judge’s perspective on which statements must be admitted? This panel will examine the contours of hearsay, the various hearsay exceptions, and how courts generally rule on the types of out-of-court statements on which many employment cases are built.
