In Sparrow v. D.C. Office of Human Rights (Aug. 29, 2013) and Smith v. D.C. Office of Human Rights (D.C. Oct. 17, 2013), the D.C. Court of Appeals reversed DCOHR’s no probable cause findings based on woefully inadequate investigations. The Court remanded both cases for further investigation. Denise Clark represented the Sparrow petitioner and Bob Fitzpatrick the Smith petitioner. They will discuss the implications of these decisions, useful tactics and strategies to employ when representing clients before DCOHR and legislative and rule-making fixes that are much needed.
