This program focused on the federal court’s new initiative allowing individual judges to pilot test early discovery in employment cases. Under early discovery, which will be a substitute for initial discovery, the plaintiffs will be provided comprehensive and robust discovery including , among other things, all communications involving the plaintiff, personnel and related files, performance evaluations and disciplinary records, documentary basis for adverse decisions, relevant workplace policies, compensation and benefits history for three years, etc. Joe Garrison, former NELA President and proponent of early discovery, will be our guest speaker and he will describe the initiative in detail, its benefits for employment lawyers and the process for initiating it in our judicial districts.
